22.2. The compliance of MHEls with the requirements under Section 22.1 above shall be determined by computing the percentage of OBT deployment based on the total number of students who completed the classroom instruction for OBT in a particular class. Provided that, students who opted not to pursue or undertake the required OBT for whatever reason, shall not be included in the computation of the percentage of deployment. Provided further that, such students shall be required to execute a duly notarized Affidavit of Undertaking stating clearly the reason(s) for not pursuing such requirement. Provided finally that, the notarized Affidavit of Undertaking shall be presented during inspection and/or monitoring activities conducted by the Maritime Administration and the Commission.
